Goods that are NOT subject to return and exchange:
According to the Resolution of the Cabinet of Ministers of Ukraine No. 172 dated March 19, 1994 and the current Decree of the Ministry of Health of Ukraine No. 360 dated July 19, 2005, the following goods of proper quality are NOT subject to return and exchange:
- medicines and means;
- hygiene items;
- cosmetics.
Goods that are subject to return and exchange:
According to the Law of Ukraine “On Protection of Consumer Rights”, such goods as medical equipment and some medical products of proper quality are subject to return and exchange, if they did not suit you in terms of functions, dimensions or other criteria. Return and exchange are possible if the product has not been used and its commercial qualities have been preserved.
The buyer has the right to return and exchange medicines and means of improper quality. In this case, it is possible to return or exchange the goods within 14 days from the date of purchase if there is a fiscal receipt and an expert opinion. The official body in the field of quality control of medicines, which conducts this expert opinion, is the State Service of Ukraine for Medicines and Drug Control (State Service). To conduct an expert opinion, it is necessary to contact the regional department with an official request.
In the case of delivery of the order by postal or courier service, the buyer has the right to refuse the delivered medicine upon receipt and has the right to demand a refund in cases where:
- the primary and/or secondary packaging of the medicine is damaged;
- the expiration date of the medicine has expired;
- the authorized body has published a ban on the sale and use of the medicine;
- the delivered order does not correspond to the ordered one in terms of quantity or composition, name, dosage, release form, price.
The consumer has the right to return such an order to the delivery service employee without paying for the delivered medicinal product and its delivery services and/or to demand proper fulfillment of the order.
